Should this site be punished?

Every summer for the past 4 years one of our customer's competitors suddenly has a big jump in Google's (.co.uk) rankings for some of the main industry phrases, particularly "air conditioning".
We were always under the impression that they bought links before the busy summer season, as they have these strange massive jumps in the rankings. (for the rest of the year they often drop down) I recently checked out some of the back-links going to their site and noticed something I'd not seen before. Of the (approx) 480 links that showed up, around 80% of the SourceURL's ended with "?Action=Webring" (see 1st attached image).
To me it doesn't look natural at all and I'm surprised that Google hasn't picked up on. Their site is www.aircon247.com. It had been mentioned to me that this may be to do with link sharing sites (which I assume is black-hat) but I'm not 100% sure that they are doing this.
They also have an identical long spammy-looking footer at the bottom of every page which is clearly only for search engines to see. We reported it to Google a year ago but no action was taken. Do you think that it is acceptable to have it on every page? (see 2nd attached image)
I would be interested to know your thoughts on both of these, and whether this would be a dangerous tactic to try and emulate?

Yes they "should" be punished. But they probably won't, at least not for a long time. To Google's own detriment they don't act on spam reports nearly enough, which results in spam working more than it should, which results in more spam... and frustrated competition who were playing fair deciding "If you can't beat them, join them". The all the combined intelligence over at Google you'd think they'd figure out that for long term benefits it's best to act on the spam reports instead of just gathering data from them.

My personal view, although I'm sure some will disagree and stamp on my toes, is that complaining about competitor tactics is a waste of time. The chances of Google adding a manual penalty based on your report is very, very slim so your time is better spent working out ways to beat them the right way.
Looking at their backlink profile, there are a huge amount of paid links, general directories and not really much else. With that in mind I'd say that although they have a decent amount of linking domains it should be possible to beat them without using the same tactics.
Another thing to remember is that even if you did go down the route of trying to copy their method you wouldn't be guaranteed to succeed so might waste a load of time and money with nothing to show but a penalty.
As for the spammy footer... it might be adding some benefit to their site but I doubt it's having a huge impact... and it just looks horrid!

Why don't I outrank this site?
Hi Mozzers, I'm mystified. Why doesn't our site www.bosphorusyacht.com (ranked 15) outrank this site www.bosphorustour.com (ranked 5 and 6) for the keyword "bosphorus cruise"? Particularly for US based searches. We have far more links, shares, higher DA and PA and more related unique content on topic. Somehow they are even appearing with double listings in this search. Why is this? Am I missing something? Any ideas or suggestions appreciated.

Suspicious external links to site have 302 redirects
Hi, I have been asked to look at a site where I suspect some questionable SEO work, particularly link building. The site does seem to be performing very poorly in Google since January 2014, although there are no messages in WMT. Using WMT, OPenSiteExplorer, Majestic & NetPeak, I have analysed inbound links and found a group of links which although are listed in WMT, etc appear to 302 redirect to a directory in China (therefore the actual linking domain is not visible). It looks like a crude type of link farm, but I cant understand why they would use 302s not 301s. The domains are not visible due to redirects. Should I request a disavow or ignore? Massive site-wide internal footer links to doorway pages: how bad is this?
My company has stuffed several hundred links into the footer of every page. Well, technically not the footer, as they're right at the end of the body tag, but basically the same thing. They are formatted as follows: [" href="http://example.com/springfield_oh_real_estate.htm">" target="_blank">http://example.com/springfield_pa_real_estate.htm">](</span><a class= "http://example.com/springfield_oh_real_estate.htm")springfield, pa real estate These direct to individual pages that contain the same few images and variations the following text that just replace the town and state: _Springfield, PA Real Estate - Springfield County [images] This page features links to help you Find Listings and Homes for sale in the Springfield area MLS, Springfield Real Estate Agents, and Springfield home values. Our free real estate services feature all Springfield and Springfield suburban areas. Partial Match Penalty Site - Move Portion & Redirect To New Site
So I have a site that currently has a partial match penalty from google, I have been working to get it removed...Bad SEO basically my site was submitted to a bunch of bad blog networks..Hopefully it gets lifted soon as we remove and disavow links. That said I was planning on moving a portion of my site to a new site since its not really the focus of the site anymore however still pays the bills. I have also have been building it more of a network of sites..So If I do that and 301 redirect the pages I moved, will the penalty carry? On the current site I planned on using Rel no follow to any links that I may change in the header/menus etc.. Some of these pages I believe have the penalty while others dont. I really just dont want to screw anything else up more then it is? My biggest fear is that its perceived as a blackhat method or something like that? Any thoughts?

Why is our site being penalized?
The rankings for our transcription site (gmr transcription) fell around Jul 19. Its been an uphill task to get the rankings back particularly for the keyword 'transcription services'. As per our opinion except for one competitor the rankings of the other top 4 makes no sense to us. We have tested our site and there seems to be no reason for it to be penalized. After a month of trial I am reaching out to the community for advise.

Why are these sites so high with poor relevant links...
Hello, Keyword: TV Stands. I have been researching competitors for a client and we seem to be unable to understand why certains pages are ranking on page 1 of Google UK for keyword TV Stands. eg: http://www.furnitureinfashion.net/plasma-TV-stand.html (Google UK 8 - TV Stands) http://direct.tesco.com/q/N.1999542/Nr.99.aspx (Google UK 9 - TV Stands) The furniture in fashion has links from sites like: http://www.ummah.com/forum/ and http://www.muslimco.com/ which is totaly irrelevant to the site. Any ideas on other things as the tesco.com site does not have direct links to it. Cheers
