How to make second site in same niche and do white hat SEO

Hello,
As much as we would like, there's a possibility that our site will never recover from it's Google penalties.
Our team has decided to launch a new site in the same niche.
What do we need to do so that Google will not mind us having 2 sites in the same niche? (Menu differences, coding differences, content differences, etc.)
We won't have duplicate content, but it's hard to make the sites not similar.

I'm sorry to hear that I would recommend requesting the people linking to your existing site that are using high quality powerful links to update the back link to point to your new site.
the advantages of dealing with people with legitimate sites are they are much easier to find and will actually help you with these types of things. It's not the nightmare that it is trying to get a hold of a blackhat webmaster.
Outside of creating a 100% legitimate website with a slightly different niche may be content, inbound marketing whatever buzzword you want to use for the very short time I hope it takes you to get your most powerful white hat links to point to your new website.
Removeem.com It is a wonderful tool for finding the names and contact info of webmasters you can use it to make a polite request saying that you have a new domain and you would appreciate if they would please update the link pointing at your site.
After you have taken the best Backlinks away from your existing site I would move to your new site.
I would also be upfront about moving place text saying you are changing domain names in a conspicuous location on your site.
If you feel that your livelihood is being jeopardized by this I definitely can understand I would then really put 110% into creating some top-notch content and user friendly/mobile design on your new brand. When you go live you want to really have something better than what you had before.
I'm sorry I don't know any methods that would be instant but I would consider using pay per click to soften the blow.

I appreciate the responses and they make sense. I don't see a solution. I don't see our current site ever pulling out of penalty no matter what I do and we've got an income off of it.
Any ideas?

with all that said I think if you go after a slightly new niche or offer things from a different angle you're obviously doing twice the work.
Are you concerned that if you 301 redirect you will be bringing the penalty over?

talking about taking the new site and building it using white hat tactics that were implemented after the penalty in which the original site has yet to return from. I know that creating sites that are essentially going to be the same but contain unique content just to get better rankings is against the rules.
if you remove the first site after building the first site using white hat methods currently employed on the existing site
( I should say domain because that's what's coming down to right?)
it would be in your best interest to remove the first site when the second website goes live.
I know this is not the ideal situation because you probably have some good Backlinks on the original but having two sites that are competing for the same niche owned by the same person/company would be competing for the same place in the SERPS I believe would be considered a method of rigging the system.
if you have one site that is completely fine if you have one that is going to go after different niche that is completely fine.
I am basing this on an e-commerce client of mine who had competitor selling the exact same product with unique content across three domains.
The client reported this to Google and the spam team acted or there was an incredible coincidence because two months later sites reported could not be found in Google's index.

Domain name for seo
Lets say that my competitor has the domain name and website called remotecontrolcar.com , .net and .org . And he has great links and good white hat google juice. What if I get MyRemoteControlCar.com , .net, and .org domain name.. Would my domain name help me in rank against him as long as I have similar google juice? Thanks.

Alt tag best practices for a mutli gallery site with hundreds of images
I have neglected to add alt tags to one of my sites, and am ready to tackle the project. I want to make sure I do not do something that will have a negative impact on rankings....and I have not been able to find info that fits my situation. The pics are all about a product I make and sell through the site. I have a free gallery section that has about 10 galleries with about 20 pics each. Each gallery page has a different model and/or context of how the product. might be used. These are not sales pages directly just thumbnail galleries linked to larger images for the viewers enjoyment. I have 10 or so keyword phrases that would be good to use, with the intent to start getting listed in google images and other rank enhancements. Can I choose one keyword phrase as my alt tag choice for a whole gallery and give each individual large pic in the gallery that same alt tag, And use a different phrase for the next gallery's pics etc.? Or is that thought of as stuffing, and I would have to come up with a different keyword phrase for each pic? I hope that makes sense. Thanks Galen

Does Google Consider a Follow Affiliate Link into my site a paid link?
Let's say I have a link coming into my domain like this http://www.mydomain.com/l/freerol.aspx?AID=674&subid=Week+2+Freeroll&pid=120 Do you think Google recognizes this as paid link? These links are follow links. I am working on a site that has tons of these, but ranks fairly well. They did lose some ranking over the past month or so, and I am wondering if it might be related to a recent iteration of Penguin. These are very high PR inbound links and from a number of good domains, so I would not want to make a mistake and have client get affiliates to no follow if that is going to cause his rankings to drop more. Any thoughts would be appreciated.

Dust.js Client-side JavaScript Templates & SEO
I work for a commerce company and our IT team is pushing to switch our JSP server-side templates over to client-side templates using a JavaScript library called Dust.js Dust.js is a JavaScript client-side templating solution that takes the presentation layer away from the data layer. The problem with front-end solutions like this is they are not SEO friendly because all the content is being served up with JavaScript. Dust.js has the ability to render your client-side content server-side if it detects Google bot or a browser with JavaScript turned off but I’m not sold on this as being “safe”. Once written, the same dust.js template can be rendered not only in the browser, but also on the server using node.js or Rhino.” Basically what would be happening on the backend of our site, is we would be detecting the user-agent of all traffic and once we found a search bot, serve up our web pages server-side instead client-side to the bots so they can index our site. Server-side and client-side will be identical content and there will be NO black hat cloaking going on. The content will be identical. But, this technique is Cloaking right? From Wikipedia: “Cloaking is a SEO technique in which the content presented to the search engine spider is different from that presented to the user's browser. This is done by delivering content based on the IP addresses or the User-Agent HTTP header of the user requesting the page. When a user is identified as a search engine spider, a server-side script delivers a different version of the web page, one that contains content not present on the visible page, or that is present but not searchable.” Matt Cutts on Cloaking http://support.google.com/webmasters/bin/answer.py?hl=en&answer=66355 Like I said our content will be the same but if you read the very last sentence from Wikipdia it’s the “present but not searchable” that gets me. If our content is the same, are we cloaking? Should we be developing our site like this for ease of development and performance? Explain To Me How Negative SEO ISNT Real?
I'm seeing lots of "offers" springing up to do negative SEO on your competitors. I know people keep insisting this sort of thing is just a bogeyman, but follow my logic here: We know the Penguin update PENALIZED, and not just devalued "over optimization." Read: exact match keyword links. We know that if your link profile is too "unnaturally" keyword heavy, (it should be majority your brand or your domain or your company name, etc) you get penalized. Again, not devalued, PENALIZED. Ok. So what is to stop a blackhatter from using one of those software bots to just kill a competitor? Knowing the above two points, lets say a website is ranking for "cool widgets". Why not just create a bunch of exact match keyword spam links for "cool widgets" targeting that website. In a while, the Penguin penalty kicks in and bammo. The thing that scares me about the post Penguin landscape is that google has specifically named an activity ("over optimization") that will get you PENALIZED. So, don't do that, right? Except, that means they've explicitly outlined an activity that will be penalized, and is easy for others to do to you, and that you would be powerless to prevent. I await the usual "this is an age old worry that has never come true" replies. But if you reply that way, ask yourself, can you refute the logic of the points above? And also... oh no... It's happening. I'm seeing it.
