Local Subdomain vs. Local Subfolder

I know this is an issue that's been discussed here ad nauseum but I have, possibly, an interesting case. A third party company created our local search pages, and they perform very highly in SERPs, but are subdomains (local.website.com). But my problem comes down to two things, one of which isn't necessarily a subdomain vs. subfolder issue.
1.a. With the subdomain local.website.com we rank much higher for local search than we do for regular search on our main domain and it's respective keywords, would changing these subdomains to subfolders keep the link juice that the subdomain currently possesses and actually help our website rankings?
b. And what strikes me as the most puzzling is that on local.website.com ALL of the content is identical (I can thank Copyscape for that) to the other local search pages on our own site and various other sites in our industry. I know the duplicate content is hurting our domain, which makes it even more confusing that our subdomain is ranking so highly for things like "diamonds by the yard florida".
2. We're an online only company, and I feel as though gaming the local search function isn't exactly something we should be doing, both from an ethical and an SEO standpoint. Is there any evidence that abusing the local search functions can have a negative affect on a domain's rankings?
Hopefully this makes sense, if anyone needs clarification please let me know and I'll endlessly clarify.

To add to what Cyrus has said, Google will "choose" a version of content it finds duplicated to favour, so has clearly chosen the local. subdomain. The main website would likely fall back into favour if you were to consolidate the subdomain and redirect it to the main site, but I would definitely find out if the third party agency who developed the subdomain has done some promotion of the subdomain that you aren't aware of.
There is no real problem using subdomains or subfolders for specific local rankings / campaigns. I wouldn't say you are gaming or abusing it here - you have a dupe content problem that needs fixing though.
If you were to use subfolders, the duplicate content problem would remain as long as there are multiple versions of the same content, but if you were to consolidate the main site and subdomain's strength, then any subfolders you added to the one remaining site (assuming all content was unique) should inherit authority.

Interesting. I can only imaging that the company that created your local subdomain pages is promoting those pages through local optimization over your root domain, and that's why they are ranking - although this is only a guess.
On one hand, we often get questions about the subdomain/root issue. The simple answer is: if it ain't broke, don't fix it. Google often associates your subdomian with your root, so moving it doesn't always mean an improvement in rankings.
On the other hand, duplicate content is a problem. In this case it might be worth it to 301 redirect the duplicate content to your main domain, and drop the stuff that is duplicated from your other sites.
To address your final question, what you do in the local space can impact your regular SEO, because there is some overlap between the two. One often influences the other.

Why does Google only display a 3 pack of local business results for some terms?
We have seen a pattern in the Google UK SERPS where only three local listings are triggered for a query although they have a more local results to show but chose to only show three: Anyone else seen this? Local Markup
Is there a way to use local markup for different cities? The point is we have one location but we offer our products in many cities. Through markup we want to indicate that we are also relevant in these cities other then our base location. Does any of you have experience with this or has a solution without manipulating Google?

Multiple locations and local directories
Hello, A client has opened a new office in another city. I have created a local landing page for this city. Now I want to build citations for it. However, I have already set up directories like Yelp/Yell with the primary/original address in the original city. Is it OK to set up new citations using the new city local address. The company name stays the same obviously. So I will have duplicate listings on the directories for the same company. Will this work? Thanks for any help

Local seo citation tools
Hi I have been manually adding my details to local/national directories in order to help my ranking in my google places placing. It is a bit of a grind, and I am aware there are tools out there. I was wondering if anybody has any experience with any of them? I am UK based. Also I was ranking for "Liverpool Photographer" on google places for a couple of months and it brought in quite a bit of work, although I have since slipped back to about 15th, so out of the visible results. I am mainly a wedding photographer so my home page was optimised mainly for "liverpool wedding photographer" Although I hired an SEO company who changed the home page title to "liverpool photographer", I cannot remember if I was ranking on places for this keyword because of this change or I was already in the results before the changes were made. So my question is how Can I rank for "liverpool photographer" and "Liverpool wedding photographer" on a places result at the same time? I hope this makes sense. Best wishes. David.

Combining Law websites to boost local results?
So we currently have 2 separate websites for the 2 areas of law we practice, Criminal Defense and Family. Currently our Criminal Defense website is the one affiliated with our google+ page and so it ranks well in local results, where as our Family website does not rank at all locally. Would it be best for our Family practice if we merged it with our Criminal site? We all work out of the same office and share address and phone number, so I don't believe we can associate the Family website with a google+ page, but I am wondering if each site would show up in Local results for their individual keywords if the criminal site and law site were both subdomains of a main Firm website.

Branding Accuracy for Local Search
Hello Mozzers! We have a hotel client who's brand is, say "The Moz". However, they appear online with a few different variations, e.g. "The Moz", "Moz Hotel", _"The Moz Hotel". _In the past, we have tried to include the word "hotel" in client names on local listings, for search purposes.
