Title Attribute for H2 & h3 Tag SEO Question

Hi ,
We have an eCommerce Site and from looking at a competitor , they seem to be rank better than us even though our everything about our site is better . We hire the same products (are affiliated the same company) so the product list is the same. Both our category pages score A grade in Seomoz reports.
So This is what I can deduce from the competitors category page I am trying to compete against.
On the cement Mixer hire category page
- The competitor has put the Main Keyword "Cement mixer hire" in all the Title Attributes on their H2 and H3 tags as well as it being the main H1 tag. They have 5 product links in h3 tags all with the same title attribute (cement mixer hire) These links go through to product page.
Am I missing a trick here ?..... I would have though using the title attribute so much for main keyword would be a bit spammy ?.
I have copied them with the point 1 but I have not done mine h3 as yet.
Just wondering that the SEO guru's thought ?.

It's worth noting that title tags are often misused. Either because webmasters are trying to spam their keywords or because they're not aware of it's proper use.
Obviously sets the subject of the page.
Should only be used for sub sections of the page. For example:
User Reviews
is good usage, because its a sub section of the page.
Featured Product
,
Online Users
aren't really sub sections of a page, so I'd avoid using title tags for things like that.

Hi Sarah, just a thought, rather than looking at your competitors pages to see what they're doing, why not look at what you're not doing.
What can you do, to add more value for your visitors. User reviews, videos etc etc.
In terms of content, are your product descriptions the same as your competitors? If so, Google will be viewing both pages similarly and then something tips the balance. It can be inbound links, extra perceived value or even internal architecture. Perhaps their internal linking is better?
Spamming with <h>tags isn't the best strategy.</h>

Hi I have some pages on the site which have a quote form, in my site crawl I see these showing as duplicate content - my webmaster says this isn't the case, but I'm not sure. Robots.txt question
I notice something weird in Google robots. txt tester I have this line Disallow: display= in my robots.text but whatever URL I give to test it says blocked and shows this line in robots.text for example this line is to block pages like http://www.abc.com/lamps/floorlamps?display=table but if I test http://www.abc.com/lamps/floorlamps or any page it shows as blocked due to Disallow: display= am I doing something wrong or Google is just acting strange? I don't think pages with no display= are blocked in real.

WhoIs, SEO & Privacy
Is WHOIS data used by Google as a ranking signal? We had a website that had some bad SEO work done a while ago hence took a knock, If I use the same WHOIS data on a new site is that likely to cause an issue? Also I don't like the idea of providing too much information for privacy reasons, so have tended to stick to general email addresses and department names rather than actual personal information. Is that a bad approach?

Technical Site Questions
When i do a google cache of our site, i see 2 menus, our developers say that's because the 2nd is for the mobile menu - is that correct, as when i look up other sites that have mobile rendering they only have one menu visible. Plus GWT's has the number of internal links per page at least x2 what they should have - are they connected? Secondly when i do a spider test through http://tools.seobook.com/general/spider-test/ it shows all "behind the scenes text" eg font names, portals, sliders, margins - "font size px" is shown as 17 times and a density of 2.15% - surely this isnt correct as google will be thinking that these are my keywords !? Missing Title Tags on Include Files?
GWT is telling me 3 of my include files (Contact Form - Header - Footer) are missing a Title Tag. This has never happened to me before and don't know how to tackle it. On the other hand the warning refers to a subdirectory of my site to these respective include files… The main directory, with literally the same html structure and no Title, returns no errors. Any ideas as to why this error now? or how to fix it? Thanks,
